Focused immigration experience for high-stakes cases
Brennan Gian-Grasso is a founding partner of Gian-Grasso & Tomczak Immigration Law Group. He is a member in good standing of the Pennsylvania Bar and focuses his practice exclusively on immigration law, with particular experience in the immigration consequences of criminal convictions.
Removal Defense and Appellate Work
Brennan’s primary practice focuses on removal defense in both detained and nondetained contexts, including deportation defense, litigation, and appellate work before the Board of Immigration Appeals.
He has successfully litigated cases before immigration courts administered by the Executive Office for Immigration Review in Philadelphia, New Jersey, New York, Baltimore, and Orlando. He has also won cases before the Board of Immigration Appeals and the US Court of Appeals for the Third Circuit.

In the detained setting, Brennan is experienced in obtaining bond and parole for clients. He also represents individuals in complex immigration litigation, using strategies such as motions to suppress in immigration court to challenge aggressive enforcement policies that affect immigrant families throughout the community.

Federal court advocacy and immigration appeals
Brennan represents clients whose immigration matters require review or intervention in federal court. His experience includes pursuing petitions for review before federal circuit courts, filing habeas corpus petitions to challenge immigration detention, and bringing mandamus actions when government agencies have unreasonably delayed required decisions.
Before pursuing federal litigation, Brennan examines the case history, administrative record, jurisdictional requirements, and applicable deadlines. He helps clients understand what the court has the authority to address and builds a focused legal strategy around the issues presented in their case.
Criminal cases and immigration consequences
Brennan’s experience with the criminal justice system in Philadelphia and surrounding counties allows him to advise criminal defense attorneys on pleas that may avoid or minimize immigration consequences for their clients.
He has worked with defense counsel to prepare guilty plea colloquies, post-conviction relief applications, and sentence modifications. Brennan also regularly provides opinion letters that criminal defense attorneys may use during plea negotiations or sentencing.
Community and professional involvement
Brennan is a legal adviser to the Mexican Consulate in Philadelphia, providing consultations to detained and nondetained Mexican nationals. He also provides direct representation in removal proceedings and immigration applications.
He has been a featured speaker at immigration continuing legal education programs on matters involving crimmigration (criminal law and immigration law) and waivers of inadmissibility.
Brennan is a member of the American Immigration Lawyers Association. He is active in its Philadelphia Chapter, where he serves as Secretary of the Executive Committee and previously served as chapter chair from 2018 to 2019.
Education, languages, and personal background
Brennan earned his Juris Doctor from Temple University Beasley School of Law in May 2006. He also holds a Master of Science in Economic History from the London School of Economics and a Bachelor of Arts in Asian and Middle Eastern Studies from the University of Pennsylvania.
Brennan is fluent in Spanish and conversant in French.
