Compassionate advocacy for individuals and families
Kimberly Tomczak is a founding partner of Gian-Grasso & Tomczak Immigration Law Group. She believes everyone deserves the opportunity to build a life where they feel safe, secure, and hopeful about their family’s future. That belief shapes both her advocacy and the trusted relationships she builds with her clients.
The immigrant experience is also personal to Kimberly. Her mother was born in Scotland, and Kimberly witnessed firsthand what it meant for someone she loved to navigate the US immigration system alone. This experience continues to drive her work as a dedicated and compassionate advocate.
Removal defense and appellate representation
Kimberly’s primary practice focuses on removal defense before the Immigration Court. She represents detained and nondetained individuals facing high-stakes proceedings, including asylum seekers and people pursuing cancellation of removal or adjustment of status.

Kimberly carefully evaluates each client’s circumstances, available forms of relief, and potential legal challenges. She provides clear guidance throughout the process while advocating for outcomes that protect her clients’ safety, families, and ability to remain in the United States.
Family immigration and humanitarian applications
In addition to removal defense, Kimberly represents individuals and families applying for immigration benefits through US Citizenship and Immigration Services. Her experience includes:

Federal litigation and appeals experience
Kimberly represents clients in federal immigration litigation when detention, agency delays, or unfavorable decisions require action beyond the administrative process. Her experience includes petitions for review before federal circuit courts, petitions for habeas corpus involving immigration detention, and petitions for mandamus seeking action on unreasonably delayed immigration matters.
Federal litigation involves strict deadlines, complex jurisdictional rules, and careful analysis of the administrative record. Kimberly evaluates the available legal pathways, explains the potential scope and limitations of federal court action, and develops arguments grounded in each client’s circumstances and applicable law.
Teaching and immigration law education
Kimberly served as an adjunct professor at Widener University Delaware Law School from 2020 to 2021, where she taught Asylum and Refugee Law.
Her teaching experience reflects her depth of knowledge in humanitarian immigration law and her commitment to helping future attorneys understand the legal principles and human realities involved in asylum cases.
Community and professional involvement
Kimberly serves as a legal adviser to the Mexican Consulate in Philadelphia. In this role, she provides consultations to detained and nondetained Mexican nationals, along with direct representation in removal proceedings and affirmative immigration applications.

Education, languages, and personal background
Kimberly earned her Juris Doctor from Temple University Beasley School of Law in January 2011. She received her Bachelor of Arts in Political Science and Spanish from La Salle University in 2007.
While attending La Salle, Kimberly spent a semester at the university’s Mexico City campus through an exchange program. The experience gave her an opportunity to travel throughout much of Mexico while strengthening her Spanish-language fluency and deepening her understanding of the country and its communities.
Kimberly is fluent in Spanish. She lives in Los Angeles.
