On February 28, 2020, the Ninth Circuit ruled to block the Trump administration’s “Remain in Mexico” (aka “Migrant Protection Protocols”) program that requires asylum seekers to wait in Mexico while their asylum claims process in the United States. The appeals court held that the policy violated the government’s responsibility to refrain from returning migrants to dangerous places. However, later that Friday, a three-judge panel decided that the policy would remain in effect to allow the government to respond with written arguments.
In a separate ruling on Friday, the same appellate court judges rejected another policy that restricts those who entered the US illegally from applying for asylum. It is difficult to see how these decisions affect migrants living in limbo while waiting for their asylum claims. See more at The New York Times and The Guardian.
